Scope
This End User License Agreement ("EULA") governs your use of FastTrack downloadable client software ("Licensed Software") as an end-user.
Licensed Software includes:
- FastTrack Merchant App — mobile and tablet application for store staff (point-of-sale, payments, refunds, receipts, and related in-store operations); and
- FastTrack Agent — desktop store agent for device and hardware integration with the FastTrack Platform ("Platform").
It applies when you install or use Licensed Software on a device or computer authorized by your employer or another business customer of Stack ("Customer").
This EULA does not govern:
- FastTrack Platform subscriptions — governed by the Customer Agreement between Stack and the Customer (the Platform Services Agreement and applicable Order).
- The www.fast-track.io marketing website — governed by our Terms of Use.
- Personal data processed on the Customer's behalf (e.g. shopper data) — governed by the data processing terms in the Customer Agreement (Data Processing Agreement).
- Shopper-facing white-label applications distributed under a retailer's brand — those are governed by the retailer's terms, not this EULA.
If you use Licensed Software on behalf of a Customer, your use is also subject to that Customer's policies and instructions. The Customer (typically your employer) is responsible for authorizing your use and for your compliance with this EULA.
Agreement
Licensed Software is licensed to you ("You" or "End-User") by Stack ehf., Laugavegur 178, 105 Reykjavík, Iceland, Reg. 641019-1270 ("Licensor", "Stack"), for use only under the terms of this EULA.
By downloading, installing, or using Licensed Software — including from the Apple App Store, Google Play, or direct deployment by your Customer's IT administrator — and any updates thereto (as permitted by this EULA), you agree to be bound by this EULA.
Stack, not any app store or distribution platform, is solely responsible for Licensed Software and its content, including warranty, liability, and maintenance and support, except where mandatory app store terms apply to the distribution channel.
If Licensed Software is obtained through the Apple App Store, you acknowledge that Apple's Usage Rules may apply to your use on Apple devices. This EULA is not intended to conflict with those rules. Apple is not a party to this EULA.
The Licensor reserves all rights not expressly granted to you. Licensed Software is licensed for use on mobile devices, tablet devices, and desktop or server computers ("Devices") authorized by the Customer.
1. The Software
Licensed Software communicates with the Platform to facilitate retail operations. Depending on which product you use:
- FastTrack Merchant App — sales transactions, payment processing, refunds, receipt generation, and related staff workflows on authorized mobile and tablet devices.
- FastTrack Agent — connectivity between in-store hardware, peripherals, and the Platform on Customer-authorized computers or servers.
Licensed Software is provided to you under the Customer's Platform subscription. It is not sold to you directly except where applicable law provides otherwise.
2. Scope of License
2.1 Updates. This license governs any updates to Licensed Software provided by Stack that replace, repair, or supplement the original software, unless a separate license applies to an update.
2.2 Authorized use. You may use Licensed Software only:
a) on Devices authorized by the Customer (mobile and tablet devices for the Merchant App; in-store computers or servers for FastTrack Agent);
b) for the Customer's business purposes in connection with the Platform; and
c) in accordance with this EULA, the Customer's instructions, and applicable law.
2.3 Restrictions. You may not:
a) share, sell, rent, lend, lease, sublicense, or redistribute Licensed Software;
b) reverse engineer, decompile, disassemble, or attempt to derive the source code of Licensed Software, except as permitted by mandatory law or with Stack's prior written consent;
c) copy or alter Licensed Software except as expressly authorized (including backup copies on Devices you control, provided unauthorized third parties cannot access them);
d) remove intellectual property notices;
e) use Licensed Software after your authorization is revoked or this license terminates;
f) circumvent technical restrictions or usage limits set by the Customer or Stack.
If you sell or transfer a Device, you must remove Licensed Software from that Device first.
3. Technical Requirements
3.1 Stack may update Licensed Software to support new firmware, hardware, or Platform features. You are not entitled to demand any particular update.
3.2 You are responsible for ensuring your Device meets the technical requirements for Licensed Software (including network connectivity to the Platform as described in the Customer Agreement).
3.3 Stack may modify technical requirements at any time. Material changes that prevent use on previously supported Devices will be communicated through the Customer where reasonably practicable.
4. Maintenance and Support
4.1 Stack is responsible for maintenance and support for Licensed Software as described in the Customer's Order and the Customer Agreement (including the Support Policy where applicable).
4.2 For support, contact support@fast-track.io, your Customer's designated IT administrator, or — if you are a business customer user — your in-dashboard support desk at [your-tenant].fast-track.io/support.
4.3 App store operators (Apple, Google, etc.) have no obligation to provide maintenance or support for Licensed Software.
5. Use of Data and Privacy
5.1 You acknowledge that Stack and the Customer may process data generated through your use of Licensed Software (including transaction data, device identifiers, and account information) to provide the Platform, as described in:
- the Privacy Policy (for data Stack controls as a controller, e.g. support contacts); and
- the Data Processing Agreement and Customer Agreement (for data Stack processes on the Customer's behalf).
5.2 Stack may collect technical data about your Device, operating system, and software usage to provide support, deliver updates, maintain security, and improve products, provided such data is aggregated or does not personally identify you where used for product improvement outside direct support.
5.3 You must not enter personal data into Licensed Software except as authorized by the Customer and permitted by applicable law. The Customer is responsible for privacy notices to end customers (e.g. shoppers).
6. Acceptable Use
You agree to use Licensed Software only for lawful business purposes and in accordance with this EULA and the Customer's instructions. You must not:
a) use Licensed Software for any illegal, harmful, or unauthorized purpose;
b) introduce malware or attempt to compromise Licensed Software, the Platform, or related systems;
c) access or use Licensed Software in a manner that violates third-party rights or applicable law;
d) share credentials or allow unauthorized persons to use Licensed Software under your account; or
e) interfere with other users' or Customers' use of the Platform.
Violation may result in immediate suspension or termination of your license and disciplinary action by the Customer.
7. Liability
7.1 To the maximum extent permitted by applicable law, Stack is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of Licensed Software.
7.2 Stack's aggregate liability to you under this EULA is limited to the amount paid by the Customer for your access to Licensed Software during the twelve (12) months preceding the claim, or one hundred euros (€100) if no such fees apply, except where liability cannot be limited under mandatory law (including consumer protection laws).
7.3 You are responsible for backing up data as required by the Customer. Stack is not liable for data loss caused by your breach of this EULA, unauthorized modification of Licensed Software, or use outside Stack's specifications.
7.4 Nothing in this EULA limits liability for death or personal injury caused by negligence, fraud, or other liability that cannot be excluded by law.
8. Warranty
8.1 Stack warrants that Licensed Software, at the time of download, is free of spyware, trojan horses, viruses, and other malware known to Stack, and will perform substantially as described in the applicable documentation.
8.2 No warranty applies if Licensed Software has been modified without authorization, used with incompatible hardware or software, or affected by factors outside Stack's reasonable control.
8.3 You must inspect Licensed Software after installation and report defects to support@fast-track.io without undue delay, and in any event within ninety (90) days of discovery.
8.4 If a defect is confirmed, Stack may, at its option, repair the defect, provide a substitute, or terminate your license and direct any refund through the Customer.
8.5 If you are a consumer under applicable law, statutory warranty rights apply in addition to this section. Contact support@fast-track.io for warranty claims — not an app store operator, unless mandatory store terms require otherwise.
8.6 If you are a business user, claims based on defects expire twelve (12) months after Licensed Software was made available to you, unless mandatory law provides otherwise.
9. Product Claims
Stack, not any app store or distribution platform, is responsible for addressing claims relating to Licensed Software or your possession and use of it, including:
a) product liability claims;
b) claims that Licensed Software fails to conform to applicable legal or regulatory requirements; and
c) claims arising under consumer protection, privacy, or similar legislation, subject to the roles defined in the Customer Agreement and DPA for data processed on the Customer's behalf.

11. Termination
This license remains valid until terminated by Stack or by you (through the Customer).
Your rights terminate automatically without notice if you breach this EULA. The Customer or Stack may revoke your access at any time.
Upon termination, you must stop all use of Licensed Software and destroy all copies in your possession or control.
Sections that by their nature should survive (including Sections 5, 7, 8.5–8.6, 9, 13, and 14) survive termination.
12. Third-Party Terms
Stack will comply with applicable third-party terms when using Licensed Software on third-party platforms (e.g. mobile operating systems).
Where the FastTrack Merchant App is distributed through the Apple App Store, you acknowledge that:
a) this EULA is between you and Stack only, not Apple;
b) Apple has no obligation to furnish maintenance or support for Licensed Software;
c) Apple is not responsible for product claims, intellectual property infringement claims, or third-party claims relating to Licensed Software;
d) Apple is a third-party beneficiary of this EULA solely as necessary to enforce this EULA against you on Apple devices, and upon your acceptance, Apple will have the right to enforce this EULA against you as a third-party beneficiary.
Stack maintains this EULA to satisfy Apple's Licensed Application minimum terms where the Merchant App is distributed via the App Store. Counsel may review for App Store compliance before publication.
13. Intellectual Property
Stack and its licensors own all rights in Licensed Software and the Platform. This EULA grants you a limited license to use Licensed Software as set out in Section 2. No other rights are granted.
If a third party claims that Licensed Software infringes intellectual property rights, Stack (not an app store operator) will be responsible for investigation and resolution as set out in the Customer Agreement between Stack and the Customer.
14. Governing Law and Disputes
This EULA is governed by the laws of Iceland, excluding conflict of law rules.
Business users. If you use Licensed Software on behalf of a Customer, disputes relating to the Platform subscription are governed by the Customer Agreement between your Customer and Stack (including binding arbitration where applicable), not this section.
Other users. For disputes arising solely under this EULA, you and Stack agree to the non-exclusive jurisdiction of the courts of Reykjavík, Iceland. If you are a consumer in the EU/EEA, you benefit from mandatory consumer protection laws of your country of residence and may bring proceedings in your country of residence.

15. Miscellaneous
15.1 If any provision of this EULA is invalid or unenforceable, the remaining provisions remain in effect. Invalid terms will be replaced with valid terms that achieve the primary purpose.
15.2 Changes to this EULA require written agreement, except that Stack may update this EULA for app store compliance or legal requirements with notice through the Customer or Licensed Software. Continued use after notice constitutes acceptance where permitted by law.
15.3 This EULA, together with the documents referenced in the Scope section, constitutes the entire agreement between you and Stack regarding Licensed Software. In case of conflict:
a) for Platform subscription matters: the Customer Agreement and Order prevail;
b) for personal data processed for the Customer: the DPA (incorporated in the Customer Agreement) prevails;
c) for your use of Licensed Software as an end-user: this EULA prevails over the Terms of Use.
15.4 You may not assign this EULA. Stack may assign it to an affiliate or in connection with a merger or sale of assets.

- Apple App Store (iOS/iPadOS) — FastTrack Merchant App
- Google Play (Android) — FastTrack Merchant App
- Direct enterprise deployment by the Customer (managed devices, MDM, or manual installation) — FastTrack Merchant App
- Direct installation on Customer-authorized computers or servers — FastTrack Agent
